Uhh...cancel that last thought...I just found the article and re-read it
(I should have done that beforehand) - they are suing b/c of the use of
the streams to stimulate sales. 

I had just recalled part of the quote about using their images....

I don't remember the exact wording of why the suit was being brought but
I think it was because he was selling "replicas" of items that bore the
band's images no?  I don't remember it being over the recordings since
he's technically not profiting off those as they are offered for free
listening.
