Grant, you make a number of good points but I personally believe you are
going a bit to the extreme. Most of the examples you pointed out involved
people SELLING tapes, etc. Frankly, a very high percentage of people I have
seen openly selling on the web end up getting C&D's eventually. They may
get away with it for a few years but selling will get someone's attention
after awhile. I would not read too much into it that the C&D specified
'this' and not 'that'.
I have never thought that posting tree structures on web pages was a good
idea. As for what happened to Chris we will have to wait and see but I
would doubt it is related to the EC tree. A couple of years ago the lawyers
for the copyright holders of the Simpson's got crazy and sent C&D's to every
web site that they could find that showed an image of any of the characters
on it, unless they had written permission to display the copyrighted images
(which was none of them).....crazy....
As for not treeing the Seattle vid I would disagree but I don't think info
should be openly posted to this group. Emailing it to the persons involved
in the tree or maybe just to each branch and his leaves is probably more
secure.
I am not a paranoid person because I generally don't think my life is
interesting enough for 'the man' to bother with spying on me for. But I do
take a few precautions. On my web page I do the following:
1. I have a bit of a ruse on the front page to get into it.
2. I say the following, "Listed below are the live cd/cdr's I own. I rated
the sound quality and other information I think might be relevant to someone
trying decide to add a disc to their collection. I provide the below
information so that others trying to collect rare live recordings can have a
point of reference in deciding between various discs. I do not sell cdr's
so do not ask." (this makes it look more like a review page and not
a trading page)
3. I don't put any mp3's, even samples, on my web page.
It may not be much protection but there is nothing on my page that can be
directly shown to involve any illegal activity or copyright infringement
(and remember trading IS technically in violation of copyright law in the
US - it's a like kind exchange - something of value for something of value
which is tantamount to selling). Sure there is implied copyright
infringement on my page but it's not explicitly stated.
Anywho, just my 2 bits.
