Well you'll notice that the suit is against the club, not the bands.  It is a 
venue's responsibility to be licensed by ASCAP & BMI if cover songs are to be 
played.  This even extends to restaurants who play dinner music over the sound 
system.  We always assume that the venues we play have complied with this, but 
I suppose it would be a good idea for us to check in the future!
